1. Introduction
Welcome to the NIMAI Technologies online car auction platform ("Platform"), operated by Ekachakra Technologies (Pty) Ltd, trading as NIMAI Technologies ("we", "us", "our", or "the Company"), a company registered in South Africa.
By accessing or using this Platform, you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.
NIMAI Technologies provides an online marketplace for the auction and sale of motor vehicles and related assets. Our tagline — Asset . Management . Disposal — reflects our commitment to efficient, transparent asset lifecycle management through digital auction technology.

3. Description of Services
The Platform provides the following services:
- Online Auctions: Real-time bidding on motor vehicles and other assets listed by verified sellers
- Vehicle Listings: Detailed descriptions, photographs, condition reports, and viewing schedules for auction items
- Bidder Registration: Account creation, identity verification (KYC), and deposit management for prospective buyers
- Payment Processing: Secure processing of deposits, winning bid payments, and buyer's premiums
- Seller Services: Asset listing, lot management, auction scheduling, and settlement processing for organisations disposing of vehicles
- Viewing Coordination: Scheduling and management of pre-auction vehicle inspection sessions
We act as an intermediary platform connecting buyers and sellers. Unless expressly stated otherwise, NIMAI Technologies is not the owner of the vehicles listed on the Platform.
4. User Accounts and Bidder Registration
To participate in auctions, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Before you may place bids, you must complete our Know Your Customer (KYC) verification process, which requires submission of:
- A valid government-issued identity document (South African ID, passport, or driver's licence)
- Proof of residential address (utility bill or bank statement dated within the last three months)
- Bank statement or proof of banking details
You must be at least 18 years of age and legally capable of entering into binding contracts under the laws of South Africa.
We may suspend or terminate your account at any time if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or failed to complete payment obligations.
5. Bidding Rules
All bids placed on the Platform are legally binding offers to purchase the item at the bid price, plus any applicable buyer's premium and fees. Once a bid is submitted, it cannot be retracted.
You shall not:
- Place bids without a genuine intention to purchase
- Engage in shill bidding or bid manipulation
- Collude with other bidders to suppress prices
- Use automated tools or bots to place bids
- Interfere with the proper operation of the auction
Certain auctions require a refundable deposit before participation. If a bid is placed within the final minutes of an auction, the closing time may be automatically extended to allow other bidders a fair opportunity to respond.
6. Payment Terms
If you are the winning bidder, you are obligated to pay the full purchase price, which comprises the hammer price, the buyer's premium, any applicable VAT or taxes, and any additional fees as disclosed in the auction listing.
Full payment must be received within the settlement period specified in the auction listing, typically 48 to 72 hours after the auction closes. Failure to pay may result in forfeiture of your deposit and suspension of your account.
Accepted payment methods include electronic funds transfer (EFT), credit/debit card payments through our secure payment gateway, and bank-guaranteed payments. Cash payments are not accepted.
7. Vehicle Collection and Delivery
Once full payment has been confirmed, vehicles must be collected within the period specified in the auction listing (typically 5 to 7 business days). Storage fees may apply for late collection.
Delivery services may be arranged at the buyer's expense. Risk in the vehicle passes to the buyer upon collection or delivery, whichever occurs first. Ownership transfers upon full payment and completion of all necessary documentation.
8. Vehicle Condition — "As-Is, Where-Is"
All vehicles are sold on an "as-is, where-is" basis. While we endeavour to provide accurate descriptions and condition reports, these are for informational purposes only and do not constitute warranties or guarantees regarding the condition, fitness for purpose, roadworthiness, or merchantability of any vehicle.
Bidders are strongly encouraged to attend viewing sessions and inspect vehicles in person before placing bids. By bidding, you acknowledge that you have had a reasonable opportunity to inspect the vehicle or have chosen not to do so at your own risk.
9. Acceptable Use
You agree to use the Platform only for lawful purposes. You shall not:
- Violate any applicable local, national, or international law or regulation
- Transmit any material that is defamatory, obscene, or otherwise objectionable
- Attempt to gain unauthorised access to any part of the Platform or its systems
- Introduce viruses, malware, or other harmful code
- Scrape, harvest, or collect data from the Platform without our written consent
- Impersonate any person or entity
10. Intellectual Property
All content on the Platform, including text, graphics, logos, software, and images, is the property of NIMAI Technologies or its licensors and is protected by South African and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.
11. Limitation of Liability
To the maximum extent permitted by South African law, NIMAI Technologies shall not be liable for:
- Any defects, mechanical failures, or latent defects in vehicles sold through the Platform
- Any inaccuracies in vehicle descriptions, mileage readings, or condition reports
- Any indirect, incidental, consequential, or special damages
- Any loss of profit, business, or anticipated savings
Our total aggregate liability shall not exceed the buyer's premium paid in respect of the relevant transaction.
12. Indemnification
You agree to indemnify, defend, and hold harmless NIMAI Technologies, Ekachakra Technologies (Pty) Ltd, and their respective directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of your use of the Platform or breach of these Terms.
13. Dispute Resolution
In the event of any dispute, the parties shall first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may refer the matter to mediation under the rules of the Arbitration Foundation of Southern Africa (AFSA). If mediation fails, the dispute shall be resolved by arbitration administered by AFSA.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the courts of South Africa.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
